DMCA & Copyright Policy

Clear, transparent guidelines on how IgnoreHost manages intellectual property notices, legal jurisdiction, and content rights.

Effective Date: January 1, 2024 Last Updated: September 23, 2026
Important Jurisdictional Notice IgnoreHost infrastructure is hosted in the Netherlands and Bulgaria under European Union regulatory frameworks (Directive 2000/31/EC and Regulation (EU) 2022/2065 Digital Services Act). We are not subject to Title 17 of the United States Code § 512 (DMCA).

1 Jurisdictional Authority & Safe Harbor

IgnoreHost operates as an intermediary hosting provider (Information Society Service Provider). Our primary network hubs and servers are located exclusively in Amsterdam (the Netherlands) and Sofia (Bulgaria).

Under the Dutch Civil Code (Burgerlijk Wetboek, Article 6:196c) and Bulgarian Electronic Commerce Act, hosting service providers are granted safe harbor immunity and cannot be held liable for third-party stored data, provided the provider does not have actual knowledge of illegality established by a competent local court.

2 How We Handle Copyright Claims

Unlike United States hosting providers that automatically suspend customer accounts upon receiving an unverified email, IgnoreHost rigorously reviews all communications:

  • Automated & Bot-Generated Claims: Automated scraping notices sent via bulk automated tools are non-actionable and discarded.
  • Extraterritorial Claims: Notices citing solely US federal statutes (such as 17 U.S.C. § 512) without valid European legal standing are not legally binding on our infrastructure.
  • Legitimate European Judicial Orders: We honor valid, enforceable court orders issued by competent judicial authorities in the Netherlands or Bulgaria following due process.

3 Formal Abuse Notification Protocol

If an intellectual property owner or authorized representative wishes to submit a formal complaint, the notification must contain the following verified details to be evaluated by our legal compliance team:

  1. Exact identification of the copyrighted work claimed to be infringed with verifiable registration evidence.
  2. Direct, specific URLs (exact file links) hosted on our IP space showing the alleged infringing material. Generic domain-level claims are invalid.
  3. Evidence of legal authority to act on behalf of the owner in the European Union.
  4. Full legal name, physical address, telephone number, and verifiable email address of the complaining party.
  5. A signed statement under penalty of perjury declaring that the information provided is accurate and that the complainant is the lawful copyright holder.

4 Customer Defense & Counter-Notice Procedure

We firmly defend our customers against anti-competitive, bad-faith, or fraudulent copyright claims. If a formal notice is forwarded to a customer, the customer has the opportunity to submit a counter-notice affirming their rights or fair use defense.

Upon receipt of a valid counter-notice, no account or service will be restricted unless the complainant presents formal proof of pending litigation in a court of competent jurisdiction.

5 Zero-Tolerance Prohibited Content

Our offshore privacy policy is strictly designed to protect legal free speech and civil liberties. The following malicious activities are strictly prohibited across all IgnoreHost networks:

Child Sexual Abuse Material (CSAM)
Phishing & Financial Identity Scams
Botnets, Malware & Ransomware C2
Terrorist Propaganda & Violent Crime

Any server discovered hosting or facilitating the above prohibited materials will be terminated immediately without prior notice or refund.

6 Designated Compliance Agent

All formal communications, legal notices, and compliance requests must be directed in the English or Dutch language to our designated compliance desk:

Department: Legal & Abuse Compliance Unit
Entity: IgnoreHost Cloud Infrastructure BV
Jurisdiction: Amsterdam, The Netherlands
PGP Fingerprint: 84F2 91A7 CE33 B810 4D5E 9812 7C92 E0F1 391A 48DE

Legal FAQs

Answers regarding our DMCA immunity and safe harbor procedures.

No. The Digital Millennium Copyright Act (DMCA) is a United States federal statute without extraterritorial jurisdiction. As our infrastructure is located within the European Union (the Netherlands and Bulgaria), US DMCA notices have no direct legal enforceability against our servers.
No. Automated, bot-generated notices or unsubstantiated takedown requests are systematically discarded. Customer accounts are never arbitrarily terminated based on third-party emails or unverified claims.
We comply strictly with legally binding court orders issued by competent judicial authorities within the Netherlands or Bulgaria following due process. Such orders are handled transparently through formal legal counsel.
We maintain zero tolerance for child sexual abuse material (CSAM), phishing/banking scams, botnet command and control, malware distribution, and terror-related activities. Accounts engaging in these malicious violations are terminated immediately.
